Mandatory Independent Concierge Disclosure

Jockey Ventures is an independent on-demand courier concierge and technology platform. Orders placed on delivery.jockeyvc.com are purchased by independent couriers at physical retail stores at published shelf prices on behalf of the customer. Delivery times are estimates and depend on store hours, courier availability, and whether the item is on the shelf at the time of purchase. Third-party trademarks, brand names, and store logos are the property of their respective owners and do not imply endorsement, authorization, or sponsorship.

Jockey Ventures (operating as Jockey VC / Jockey Delivery, 'delivery.jockeyvc.com' / 'jockeyvc.com') is an independent retail technology and on-demand personal courier platform. We act solely as an independent concierge agent for the customer to procure in-stock physical retail items directly from local retail merchant stores at published shelf prices. Unless explicitly designated as an Authorized Partner, all product trademarks, registered brand names, and merchant names belong exclusively to their respective trademark holders and are utilized for nominative identification of local inventory.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "User", or "you") and Jockey Ventures (doing business as Jockey Delivery, "we", "us", or "our"), governing your access to and use of the website located at https://delivery.jockeyvc.com and our on-demand retail concierge fulfillment network.

By accessing or using our platform, placing an order, or browsing product listings, you expressly agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use our services.

2. Nature of Service: Concierge Agency Authorization

Jockey VC provides a specialized local retail technology and delivery dispatch platform that connects consumers with local physical store inventory.

1. Customer Appointment of Agent: When you submit an order on https://delivery.jockeyvc.com, you explicitly designate and authorize Jockey VC and the independent courier engaged for your order (Independent local courier partners) as your personal shopping agent and courier.
2. In-Store Purchase on Customer Behalf: As your authorized agent, our courier visits the designated local brick-and-mortar retail store, retrieves the specified merchandise from physical shelves, presents the items at the merchant's checkout register, and purchases the items at the merchant's published shelf price on your behalf.
3. Transfer of Title: Title to the purchased goods transfers to you at the physical point of sale in the retailer's store. Jockey VC does not manufacture, wholesale, or store inventory in centralized warehouses.

3. Intellectual Property & Nominative Fair Use Notice

We are committed to absolute transparency regarding commercial relationships:

• Nominative Identification: Product names, trademarks, logos, and retailer names appearing on https://delivery.jockeyvc.com are used solely to inform customers of genuine physical product availability and shelf pricing at local stores.
• No Implied Sponsorship: Unless explicitly noted with an "Authorized Retail Partner" badge, Jockey VC is not sponsored by, endorsed by, or affiliated with the third-party manufacturers, brands, or retail stores identified on our platform.
• All Rights Reserved to Owners: All registered trademarks, logos, and service marks remain the property of their respective trademark holders.

4. Transparent Pricing & Fee Structure

We enforce strict pricing transparency across every order:

• 1:1 Shelf Price Parity: The product price displayed on https://delivery.jockeyvc.com reflects the published retail shelf price at the local merchant store.
• Flat Courier Fee: A uniform delivery charge of $9.99 USD applies per delivery order for same-day on-demand courier fulfillment.
• Applicable Sales Taxes: Local and state retail sales taxes are calculated based on the merchant store location and delivery jurisdiction.
• Exact Total Before You Pay: The checkout page shows the full itemized total before you pay. The final charge will never exceed the checkout total shown to you.

5. Returns, Refunds & Cancellations

Our return and refund practices are governed by our official 30-Day Return & Refund Policy:

• You may return eligible merchandise within 30 calendar days of delivery for a 100% full refund with $0 restocking fees.
• Returns are completed free of charge with a prepaid mail-in return label. The stores we buy from cannot accept these returns — mail-in is the only return route.
• If an item is unavailable at the retail store, damaged, or incorrect, you receive a 100% refund.

6. Warranties, Limitation of Liability & Governing Law

Manufacturer Warranties: Any warranties offered by product manufacturers or original retailers pass through directly to you with the physical store purchase receipt. Jockey VC disclaims all other express or implied warranties.

Limitation of Liability: To the maximum extent permitted by applicable law, Jockey Ventures shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our service. Our total aggregate liability for any claim shall not exceed the total amount paid by you for the specific order giving rise to the claim.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Texas and the United States of America, without regard to its conflict of law principles.
